Online Gambling Laws NZ [October 2026]: Casino Licensing
A plain-English guide to where New Zealand gambling law actually stands in 2026 — the new DIA casino licensing regime, the offshore betting ban, and what is and isn't legal for you as a player.
The two laws that changed everything
Online Casino Gambling Act 2026
In force since 1 May 2026, this Act created New Zealand's first licensing regime for online casinos. The Department of Internal Affairs (DIA) is auctioning up to 15 licences. From 1 December 2026, operators that have not applied must stop serving New Zealand; qualifying applicants may continue under a transitional exemption while their applications are assessed. Winning the right to apply is not itself a licence. See the DIA provider timeline, updated 13 October 2026. The practical effect in 2026: licensed sites aren't live yet, so every casino a Kiwi can actually join is offshore.
Racing Industry Amendment Act 2025
Since 28 June 2025, TAB NZ is the only online bookmaker licensed to take New Zealand bets. Offshore sportsbooks are barred from accepting Kiwi customers, with penalties up to NZ$5m aimed at operators. Again, the offence is the operator's — but if you want a fully NZ-licensed bookmaker, TAB NZ is currently the only one.
What this means for you as a player
- Playing isn't an offence. The law regulates operators, not individual recreational players.
- Offshore is what's available. Until DIA-licensed casinos launch, offshore operators are the only online option. We tell you plainly that they're offshore.
- Winnings are tax-free. Recreational gambling winnings aren't taxed by Inland Revenue — see our NZ gambling tax guide for the crypto nuance.
- Protections differ. Offshore operators aren't bound by NZ consumer rules, so payout reliability and dispute recourse vary. That's exactly what our casino reviews weight most.
How to protect yourself until the register is live
Stick to operators with a verifiable licence (Curaçao, Anjouan, Malta), a clear withdrawal policy, and responsible-gambling tools. Set deposit limits before you play, keep records of deposits and withdrawals, and favour faster, traceable payment routes like crypto or e-wallets. When the DIA's licensed-operator register goes public, we'll link it here and flag which sites appear on it.

Play it safe
Gambling should be entertainment, not a way to make money. Set a deposit limit before you start, never chase losses, and only bet what you can afford to lose. All reputable operators let you set deposit, loss and session limits, take a time-out, or self-exclude.
